Utilities - Northwest Water and Sewer Service Agreement and Resolutions (John Nichols, Director of Public Utilities)

Issue/Action Requested:

Request that the Board of Commissioners resolve to accept the conveyance of utility system from the City of Northwest, authorize the Chairman to execute a Water and Sewer Service Agreement with the City of Northwest and any additional documents necessary for conveyance, and authorize the County Attorney to make minor contract amendments. The county will assume ownership and operational responsibility of the Northwest Water and Sewer System on or before January 1, 2020.

Background/Purpose of Request:

The City of Northwest submitted a request to the county to submit a proposal to the city whereby the county would assume ownership and operational responsibility of the Northwest Water and Sewer System. In early October 2019, the Board of Commissioners approved submitting a proposal to the City of Northwest for the county to assume ownership and operational responsibility of the Northwest Water and Sewer System. The city indicated an initial acceptance of the county’s proposal at their October 22, 2019, meeting and approved a Water and Sewer Service Agreement.

 

County staff requests that the Board of Commissioners resolve to accept the conveyance of the utility system from the City of Northwest and to approve the Water and Sewer Service Agreement with the City of Northwest whereby the county assumes ownership and operational responsibility of the City of Northwest Water and Sewer System effective on or before January 1, 2020, and that the Chairman be authorized to execute the agreement on behalf of the county.

 

As part of the agreement, the county will assume a 4.75% interest USDA General Obligation Bonds through June 2041 with a balance of $528,000.  Staff recommends paying off the USDA GO due to the 4.75% interest and the county typically does not finance projects less than $3,000,000.

 

Staff recommends a $100,000 appropriation to replace approximately 300 meters to incorporate the county's meter reading technology.

Budget amendments are to appropriate water expendable net assets $438,932, water retail revenues $42,260, sewer retail revenues $47,052 and reduce the transfer to the water capital project fund $71,888 to assume the debt service for DEQ Sewer Loan $47,052, payoff the remaining balance of a USDA GO $528,000 plus accrued interest, acquire one employee $23,719 and replacement meters $100,000
