Health and Human Services - Health Services – Local Health Department Accreditation Statements

Issue/Action Requested:
Request that the Board of Commissioners approve statements required for Local Health Department Accreditation regarding local Board of Health Adjudications and Rules. 
Background/Purpose of Request:

Brunswick County Health Services is scheduled for local health department re-accreditation as required by G.S. 130A-34.1 in early 2023. All local health departments must maintain accreditation status in order to be eligible to receive state funding.

 

Accreditation Benchmark 14 states “The local health department shall work with local, state and federal policymakers to enact policies, laws, rules, and ordinances that support individual and community health efforts.” This is accomplished by assisting the local board of health in drafting local ordinances and rules as needed in order to implement or enforce needed local public health prevention and protection activities.

 

Accreditation Benchmark 34 states “The local board of health shall exercise its authority to adopt and enforce rules necessary to protect and promote the public’s health.” This is accomplished by following the procedures for adopting rules in G.S. 130A-39.

 

Accreditation Benchmark 35 states “The local health department shall assure a fair and equitable adjudication process.” This is accomplished by receiving and hearing appeals concerning the enforcement of a local Board of Health rule and the imposition of any administrative penalties by the local health director per the procedures described within G.S. 130A-24: Appeals Procedure.

 

No adjudications were necessary and no rules were amended or adopted in the time period since the last accreditation (2017 – 2022).

 

Statements signed by the Chair of the Brunswick County Board Health to this effect are necessary to meet the Accreditation Benchmark activities (14.4, 34.3, and 35.1).

 

Staff recommends approval of the statements.
